This contract for wedding videography and photography is effective and binding from the date confirmed to be 'read' by The Client and subject to terms and conditions.
Ownership rights and responsibilities
The Client is allowed to reproduce and copy photographs and videos of the event taken by the Camera Operators for non-commercial purposes. Camera Operators and client agree that Camera Operators own any and all copy and reproduction rights and client agrees not to reproduce or copy any proof or photograph or video taken of the event for commercial use.
Payment Requirements
To reserve the event date Kitebox requires a fifty percent deposit of the agreed total fee. A date will not be considered to be held open without receipt of said payment. Said payment is not refundable for any reason unless Camera Operators cancel this contract. The remaining balance must be received by Camera Operators no later than 14 working days before the event date. Kitebox offers two edit revision for free.
Cancellation
If Camera Operators have to cancel this contract for any reason (death, injury, sickness etc.) their liability shall be limited to a full refund of all monies paid. However, and if the client so wishes, the Camera Operators will assist in the arrangement of a replacement Camera Operators of a similar style to take this place on the Client’s wedding day. A 14-day cooling off period is in operation starting from the date the Client signs this contract. After that, should the Client cancel their booking, they will forfeit their deposit and the following percentage of the remaining balance: 30 days or less before the wedding – 100%, 31-90 days before the wedding - 60%, 91-120 days before the wedding - 40%, 121 days before the wedding up until the end of the cooling off period - 0%. These charges must be paid at the time of cancellation otherwise cancellation will not be considered to have been given. Should said cancellation be a postponement, subject to availability all money paid may be applied to new wedding date. In the event of the Camera Operators taking another wedding booking on your cancelled date a full unconditional refund of deposit and monies paid will be made.
Disclaimer
The Camera Operators will make every effort to provide high quality video services including providing backup equipment. However in the unlikely event that a catastrophic mechanical failure should occur to the Camera Operators’ equipment or transport and Camera Operators are unable to provide The Client with agreed production services and/or products then Camera Operators’ liability shall be limited to a full refund of all monies paid. Camera Operators and The Client agree that Camera Operators are not responsible for any damages, consequential, emotional or otherwise arising out of the performance or non-performance of their duties. Client is responsible for making their own back-up copies of the final disc (containing the post-processed high-resolution images/films of the wedding day) presented to them by Camera Operators. If Client loses the disc, or deletes images copied from the disc, it is not the responsibility of Camera Operators although Kitebox does keep back-ups of all finished products, which may be for a limited time. Client agrees that Camera Operators may use any photographs/videos for publicity purposes. Such publicity and advertising may include publication on the Kitebox website. Other persons may take photographs/videos at the wedding and reception. However all “formal” or other shots set up by the Camera Operators will be required to be used solely by the Camera Operators a short time after Client’s guests are allowed to take pictures of the group poses. This is to ensure the shots are of a consistently high standard. The Camera Operators cannot be responsible for unusable shots due to distractions from Client’s guests (i.e. eyes pointing in multiple directions or being closed), other paid staff external to Kitebox and other circumstances beyond the Camera Operators’ control. If the Client requires posed shots of the couple the Camera Operators will require some time with Client away from Client’s guests in order to produce more personal pictures. It is the Client’s responsibility to inform their guests of this policy and to ensure they abide by it. If the use of the drone is not possible, such as If the weather is bad or the venue changes its mind about using the drone, then the client is aware that we will not be able to offer a refund. We use high quality shot-gun microphones to record audio, however if there are loud noises caused by the venue, vehicles, nature, mobile phones, or guests, we can not be held responsible if key audio is interrupted. Our aim is to make the final output of photos and films the very best we can produce in any given circumstance. The editor will make sure any footage used is technically best from the day. In the uncommon circumstance that you would like a change, the client must clearly provide us with all their required changes within two weeks of upload. Payment includes two sets of alterations to the video.
